Welcome to Gastropoint24.de or Gastropoint24, the online platform and mobile application (collectively referred to as the “Platform”) owned and operated by Eventpoint24 GmbH (“we”, “us” or “our”) . These Terms of Use ("Terms") govern the relationship between Restaurants / Merchants and Eventpoint24 GmbH ("we," "us," or "our") when Restaurants use the Gastropoint24.de platform ("Platform") for listing their services and processing Orders. By accessing or using the Platform as a Restaurant, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Platform.

Please carefully read and understand these Terms, as they constitute a legally binding agreement between you (the "Restaurant") and Eventpoint24 GmbH.
1. Restaurant Registration and Listing
- To list your restaurant on the Platform, you must create a Restaurant Account.
- You agree to provide accurate, current, and complete information during the registration process.
- We reserve the right to approve or reject restaurant listings at our discretion.
- You are responsible for maintaining the accuracy of your restaurant information and menu items.
2. Restaurant Account
- Restaurants are responsible for maintaining the confidentiality of their account credentials.
- You must notify us immediately of any unauthorized use of your Restaurant Account.
- We reserve the right to suspend or terminate Restaurant Accounts at our discretion, without notice, if we suspect any breach of these Terms.
3. Listing and Menu Management
- You agree to list accurate and up-to-date menu items, prices, and availability on the Platform.
- You are responsible for promptly updating your menu and prices to reflect changes.
- You may choose to offer promotions, discounts, and specials through the Platform.
4. Order Processing
- Restaurants are responsible for accepting and fulfilling Orders placed through the Platform.
- Orders must be prepared and delivered or made ready for pickup in a timely manner.
- You must ensure that Orders are prepared with the same quality and care as for in-house dining.
- We may provide delivery services or partner with third-party delivery providers, depending on the arrangement agreed upon. Presently we don’t provide any assistance in delivery services, you have to manage this service as your own arrangements.
5. Payment and Commission
Payment terms and commission rates will be outlined in a separate agreement cum contract.
6. Customer Feedback
- Restaurants must maintain a high standard of service and quality.
- You acknowledge that Users may provide feedback and reviews about their experience with your restaurant on the Platform.
- You have the opportunity to respond to reviews and address customer concerns.
7. Privacy
- Restaurant data and personal information are subject to our Privacy Policy, which can be found on the Platform.
- By using the Platform, Restaurants consent to the collection and use of their data in accordance with the Privacy Policy.
8. Termination
We reserve the right to terminate or suspend Restaurant access to the Platform at any time, for any reason, without notice. Termination may result from a breach of these Terms or any violation of applicable laws.
9. Disclaimer of Warranties
- The Platform is provided on an "as is" and "as available" basis, without any warranties, express or implied.
- We do not guarantee the availability of Orders or specific levels of customer demand for Restaurants listed on the Platform.
10. Limitation of Liability
- Eventpoint24 GmbH shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from the use of the Platform.
- All disputes & damage shall be handled between Restaurants & Customer directly.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Germany, without regard to its conflict of laws principles.
12. Changes to Terms
We may update these Terms from time to time. Restaurants will be notified of any changes, and their continued use of the Platform after such notification constitutes acceptance of the revised Terms.
